·  Information to visa applicants 

From Friday February 26th 2010 on, the following categories of visa applicants, who until now were submitted their visa applications directly at the Visa Section of the Consulate General of France in Shanghai, are invited to go to the France Visa Application Centre – 21st Floor, Plaza 336, No 336 Xizang Zhonglu, Shanghai 200040/appointment to be taken online on the following website http://www.vfs-france.com.cn or by calling the Call Centre at (021) 33 30 36 00 – to submit their applications :  

-          Foreign spouses and children of French Citizens

-          Foreign spouses and children of EU and EEE Citizens

-          French and Chinese Governments’ grants holders (students)

-          Scientists (The visa fee exemption is only applicable for short stay visa applications)

-          Direct foreign descendants under 21 years old or dependants of French, UE and EEE Citizens

-          Direct foreign ascendants dependants of French, UE and EEE Citizens  

This provision, which is a continuation of the outsourcing policy implementation made by the French authorities, aims to provide those categories of visas applicants with the best possible quality of reception, attention and comfort and is accompanied by :  

 - the exemption of service fee charges (usually billed by the company VFS)

 - the exemption of visas fee (which those applicants already benefited from)            

 As a consequence,  a visa applicant belonging to one of those categories will not pay any fee during his/her submission of a visa application at France Visa Application Centre at the exception, if applicable, of extra optional services (such as photocopies, EMS couriers, translations, etc) which will still be paid by applicants.

 In addition, and in approval with the Consulate General of France in Shanghai , the service fee charged by the company VFS will be increased from 200 RMB to 210 RMB from Friday, February 26th 2010 on, except for the categories above mentioned which benefit from an exemption.

·  Visa application for a Non EU citizen who have signed a civil partnership (PACS) with a French citizen

The Decree n°2009-477 of April 27, 2009 has introduced, from June 1st, 2009 on, new dispositions regarding long-term visa (e.g visa valid more than 3 months). From this date on, the following categories of visa applicants can be issued a long-term visa serving as resident permit (LTV-RP) directly by the Consulate general of France : foreign spouse of a French citizen willing to settle in France (LTV-RP valid one year), students, employees and visitors (length of stay in France from 91 days to 1 year).

In accordance with this decree, a non EU citizen who have signed a civil partnership (PACS) with a French citizen and who is willing to settle in France with his/her partner must apply a long term visa “Visit – Settle of a non EU citizen (who is of age)”.

Furthermore, if this person wishes to go to France and stay less than 3 months, she will have to apply a short stay Schengen visa for a “private visit” purpose.


Reminder regarding the validity of the passport when applying a short stay Schengen visa or a long term visa

Please remind the following rule when applying a short stay Schengen visa or a long term visa: the passport must be valid for at least more than 3 months beyond the validity of the requested visa.

For example :

For a “Long Term Visa –Resident Permit” issued on August 5th, 2009 and valid 12 months
è the visa is valid until August 4th, 2010 è the passport itself must at least be valid until November 4th, 2010.

Applicants having a passport which does not fit this requirement have to renew it or extend its validity before applying a visa.

·  * ATTENTION : *

According to the decree Nr. 2008-1176 of November 13th 2008 related to the competence of the consular area, immediately applicable; the Consulate General of France in Shanghai can only issue, apart from exceptional cases duly justified, visas to foreign nationals ordinarily residing in their consular area. Which means, foreigners residing in the Municipality of Shanghai, Province of Anhui, Jiangsu or Zhejiang

In order to verify the applicant's effective attachment to the consular area of Shanghai, applicants are invited to present, when they'll apply for a visa, the original and copy of one of the following document : hukou, identity card, residence permit or temporary residence permit issued by the competent authorities of Shanghai, Anhui, Jiangsu and Zhejiang.

Applicant who do not belong to the consular district of Shanghai are pleased to contact the diplomatic mission or consular post on which they depend :

The whole territory of the People's Republic of China, except area from the General consulate of Shanghai, Guangzhou, Hongkong, Chengdu, Shenyang and Wuhan.

·  Long-term visa serving as resident permit (LTV-RP)

The Decree n°2009-477 of April 27, 2009 has introduced new dispositions regarding long-term visa (valid for 91 days and up to 1 year), which will enter into effect on June 1st, 2009. From this date on, the following categories of visa applicants will be issued directly by the Consulate general of France a long-term visa serving as resident permit (LTV-RP):

 

  • foreign spouse of a French citizen willing to settle in France (LTV-RP valid one year);
  • study visa applicants except under age students willing to have higher education or minors willing to study in primary or secondary schools (LTV-RP valid from 91 days to 1 year);
  • employees and temporary employees (labour contract from 91 days to 1 year);
  • visitors willing to stay in France more than 91 days and less than 1 year.

 

This new visa LTV-RP, issued to applicants willing to stay in France for at least 91 days, will have the following specifications:

 

      • free movement within France, French Overseas departments and Saint-Pierre-et-Miquelon islands (but not in the other French overseas territories);
      • serves as a resident permit and allows a duration of stay in France, French Overseas departments and Saint-Pierre-et-Miquelon islands (but not in the other French overseas territories) within the validity of the visa.


New procedure from June 1st, 2009 on
Submission of a LTV-RP application in China:

No major change in the procedure of LTV-RP submission is to be pointed out except that applicants, who belong to one of the above-mentioned categories of visa applicants and wish to stay in France more than 91 days, will have to provide the following mandatory document :

      • form OFII (Office Français de l’Immigration et de l’Insertion – French Office for immigration and integration of immigrants).

 

Applicants will have to fill in this form (information requested on the first part of the form) and give the original document when submitting their visa application. If the Consulate general of France issues the visa, the original form, stamped by the French Consulate, will be returned to the applicant.


After the arrival in France:

The French Office for immigration and integration of immigrants (OFII) becomes the main interlocutor of the foreigners arriving in France. Applicants who have been issued a long-term visa serving as a resident permit (LTV-RP) will have to keep all the documents issued by the OFII in order to prove, in case of control, that they are legally staying in France. Holder of a LTV-RP will have to send to the local OFII representation , within 3 months from the date of his arrival in France, by mail with notice of receipt (accusé de réception), the original OFII form stamped by the Consulate general of France. He/she will then receive by mail an official notification from the local OFII representation to complete his registration (give his address, pay a mandatory residence tax and, if necessary, have a medical examination).



How to renew a resident permit

At least 2 months before the end of the LTV-RP validity, the holder of such a visa will have to book an appointment at the relievant local prefecture – office for immigrants – to submit a file in order to renew his/her resident permit.

    • Resident permit for skills and talents

This permit has been created for the Chinese citizens with capability to develop their special skills into full play or the ones with competent preeminence to promote the mutual economic development between FRANCE and CHINA. The candidates are supposed to provide the detailed projects in order to get such permit.

This permit prefers some fully-developed and competent scholars and personals in the fields of economy, culture, sports, science, intellectual or charity etc. The basic requirements includes : the bachelor degree with three-year working experiences, the master degree with one-year working experiences or the doctor degree.

We prefer the candidates to provide the related forcible materials concerning the introduction on their professional programs to get this permit for the smooth examination and endorsement by the French Ambassador.

The documents that should be prepared includes : (in duplicate)

1. Self-recommendation letter presenting in details on the professional program and elaborating what the mutual benefits lie in for FRANCE and CHINA. The professional program should be one of the following three options:

Industrial, commercial or craft (entrepreneur) in this case, investments' volumes cannot be less than 300,000 €uros or create equally at least more than two job positions( including the candidates).
The freelance ( prestigeous authors, translators, high-level sportsmen, artists, etc ...)
The senior employees: (high-income getters)

2. Details from the candidate: personal adress, telephone number, and e-mail.

3. Resume.

4. The highest school records and related documents with notarization that can prove the competence of the candidates to carry out the planned programs.

5. The tax rolls paid by the candidates in their residence countries.

6. The innocence-prove certificates drew up by the residence countries the candidates settle down for three years.

7. If the above projects concern the senior employees, they need to hand on the complementary documents as followed:

(a) The letters proved by French company to classify the reasons of employing the candidates and the details about the positions they get.

(b) Working Contract ( the concerned CERFA excel of the working position can be downloaded on http://www.travail-solidarite.gouv.fr/formulaires/55.html). The job category in the working contract is supposed to accord with the candidate's qualification, experiences, specialized fields and diplomas.

The candidates who are qualified with the above requirements can submit the documents directly to the General French Consulate in Shanghai to apply for talent resident permit. This kind of visa belongs to long stay visa. The Consulate will offer the receipt to prove the acceptance of the application.

The candidates can go through on the website of French Visa Application Center or dial 33303600 to make the appointment (9:00 to 17:00 Mon to Fri).

The procedures in the process of applying for the talents resident permit visa:

1. Fees for application: equate to 99 €uros ( in line with the floating currency rate, and the Consulate will not accept Euros)
2. Fill up three Long-Stay visa application forms completely and sign the names
3. Six identity photos with clear background (33mm x 44mm)
4. Notarial birth certificate. If necessary, marriage notarial certificate and the notarial birth certificate of the candidates' spouses and children.
5. The original passport and the first five pages of passport copies, all the pages with visa stamps and all the ones with seals.
6. Hukou original and copies of all the details in it.
7. The resident permit issued by government of Shanghai, Anhui, Jiangsu, Zhejiang.
8. Bank deposit original and copy.
9. Bank statement original and copy.
10. Booking flight ticket copy
11. Schengen medical reimbursement insurance original and copy.

Suppose the candidates family wants to apply for such kind of visa : they need to provide other documents as üfollowing: 

        • üMarriage certificate original, copy and translation 
        • Family relationship notariazation of the children and accredited by Waiban üif it's necessary. 
        • Bank deposit original and copy if it's necessary.

The family members with this permit needn't apply for Family Regroup visa. They will get the certificate entitled "private and family life" and they can work in France.

If it is necessary, we will ask to the candidate to give a presentation on the details of his program and project, and after that the Consulate will put forward the evaluation.

It will take 1 month to examinate the documents in the whole procedures.

Once the French Consulate approves the application, the visa with 3-month validity will be offered.

        • The issued letter of "talent resident permit". 
        • The sample letter signed by the candidate with the date to guarantee that after he gets the permit he will finally go back to his own country.

After arriving in France, the permit holder must go to the local police station to apply for the resident permit. Before getting 3-year valid "talent resident permit", the candidate has 6 months to handle the medical attestation proved by ANAEM.

        • Two sets of documents require the originals. All the materials in Chinese need the translation in French or English.

        • The Embassy will not guarantee the every success of the visa application even if the complete documents are provided.
